Terms of Service

Welcome to FastScreen (the "Service," "Platform," or "we"). By creating an account, uploading documents, or accessing our website, you ("User," "Client," or "Landlord") agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not use the Service.

1. Nature of the Service

1.1 Document Analysis Tool Only

FastScreen provides an automated software tool that uses Artificial Intelligence (AI) to extract data, verify mathematical totals, and detect potential anomalies in documents uploaded by the User.

1.2 Not a Consumer Reporting Agency

You acknowledge and agree that FastScreen is NOT a "Consumer Reporting Agency" as defined by the Ontario Consumer Reporting Act, the U.S. Fair Credit Reporting Act (FCRA), or similar legislation.

  • We do not maintain a database of tenant histories.
  • We do not provide credit scores or background checks.
  • We do not provide recommendations to "Approve" or "Deny" any applicant.

1.3 No Professional Advice

The reports generated by our Service are for informational purposes only. They do not constitute legal, financial, or real estate advice. You are solely responsible for interpreting the data and making your own leasing decisions.

2. User Obligations & Warranties

2.1 Consent to Collect Data (Crucial)

By uploading any documents belonging to a third party (e.g., a prospective tenant or applicant), you warrant and represent that you have obtained explicit, written consent from that third party to:

  • Collect their personal information.
  • Share that information with a third-party service provider (FastScreen) for the purpose of analysis and verification.
  • Process that information using cloud-based Artificial Intelligence tools.

You agree to indemnify and hold FastScreen harmless from any claims, damages, or fines arising from your failure to obtain necessary consent under PIPEDA (Canada) or other applicable privacy laws.

2.2 Compliance with Housing Laws

You agree to use the information provided by our Service in strict compliance with all applicable laws, including but not limited to:

  • The Ontario Human Rights Code (or equivalent in your jurisdiction).
  • The Residential Tenancies Act.
  • Fair Housing laws regarding discrimination.

You agree NOT to use our Service to discriminate against applicants based on race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity, age, marital status, family status, or receipt of public assistance.

3. Accounts and Payment

3.1 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account.

3.2 Fees and Billing

Services are billed according to the pricing plan selected at checkout. All payments are processed securely via Stripe.

No Refunds: Due to the digital nature of the Service (immediate data processing), all sales are final. We do not offer refunds once a document has been analyzed.

Price Changes: We reserve the right to modify our pricing at any time, with notice provided for subscription renewals.

4. Artificial Intelligence & Accuracy Disclaimer

4.1 AI Limitations

Our Service utilizes Large Language Models (LLMs) and Optical Character Recognition (OCR) technology. While we strive for high accuracy, AI technology is not infallible. It may occasionally:

  • Misread handwriting or low-quality images.
  • Make errors in extraction ("hallucinations").
  • Fail to detect sophisticated forgeries.

4.2 User Responsibility to Verify

You agree that you will manually verify the original documents against the summary report provided by our Service before making any tenancy decision. FastScreen does not guarantee the authenticity of any document or the accuracy of any report.

5. Intellectual Property

5.1 Our IP

The Platform, including its code, design, algorithms, and "look and feel," is the exclusive property of FastScreen. You may not reverse engineer, copy, or scrape our technology.

5.2 Your Data

You retain ownership of the documents you upload. You grant FastScreen a limited, non-exclusive license to process, analyze, and temporarily store these documents solely for the purpose of providing the Service to you.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • In no event shall FastScreen, its directors, employees, or partners be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Service.
  • Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

7. Indemnification

You agree to defend, indemnify, and hold FastScreen harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party right, including any privacy right or intellectual property right.
  • Any claim by a tenant or applicant regarding the handling or analysis of their data.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms (e.g., uploading data without consent or using the platform for discriminatory purposes).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, for the resolution of any disputes.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this site. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
